The goals to be achieved in estate planning are varied and depend on your personal situation. One goal may be to ensure that minor children are adequately taken care of. Another goal might be to set up a plan for the future qualification for Medicaid to cover the astronomical cost of long term nursing care. A third goal might be to put a plan in place to minimize estate taxes.

The federal estate tax law is currently in a state of flux. For persons passing away in 2010, there is no federal estate tax imposed on the estate. However, in the year 2011, the federal estate tax is currently slated to return, with an exemption amount of $1,000,000.00 and a maximum rate of 55%. While it is expected that the U.S. Congress will pass some type of estate tax legislation before the end of the year 2010, possibly with an exemption amount of $3,500,000.00 and a 40% maximum rate, this is not a guarantee. The current state of the federal estate tax is intolerable. It is impossible to predict what the estate tax law will be in 2011. For those persons whose estates are larger than $1,000,000.00, it is recommended that you meet with an estate planning attorney to discuss your options.
